1. Acceptance of Terms

By downloading, installing, accessing, or using Soul Surgery Sunday (the "App"), developed, owned, and operated by Bavity LLC, a limited liability company ("Bavity," "the Company," "we," "us," or "our"), you ("you" or "User") agree to be bound by these Terms of Use ("Terms"). These Terms constitute a legally binding agreement between you and Bavity LLC. If you do not agree to all of these Terms, you must immediately cease all use of the App and delete it from your device.

2. Eligibility

You must be at least thirteen (13) years of age to use the App. If you are between the ages of 13 and 18 (or the age of legal majority in your jurisdiction), you may only use the App with the consent of a parent or legal guardian who agrees to be bound by these Terms. By using the App, you represent and warrant that you meet these eligibility requirements.

3. Description of Service

Soul Surgery Sunday is a personal reflection and self-examination application that provides structured weekly journaling sessions, AI-powered behavioral pattern analysis, personalized insights, mid-week reflection notifications, and PDF session export functionality.

4. User Accounts

• You are responsible for maintaining the confidentiality and security of your account credentials. You agree not to share your password or allow others to access your account.
• You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
• You are solely responsible for all activities that occur under your account.
• You must notify us immediately at support@soulsurgerysunday.com if you suspect any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

5. Subscriptions and In-App Purchases

• The App offers a free tier and a paid "Pro" subscription with additional features, including but not limited to cloud storage, extended retention, AI-powered analysis, PDF export, and mid-week reflections.
• Pro subscriptions are billed on a recurring basis (monthly or annually) through Apple's App Store. By subscribing, you authorize recurring charges to your Apple ID account.
• Subscriptions automatically renew unless auto-renewal is turned off at least twenty-four (24) hours before the end of the current billing period.
• You may manage your subscription and turn off auto-renewal at any time through your Apple ID Account Settings.
• No refunds will be provided for any partial subscription period. All refund requests are handled exclusively by Apple in accordance with Apple's refund policy.
• Prices are subject to change. We will provide notice of price changes in accordance with applicable App Store policies.
• Free trial periods, if offered, automatically convert to paid subscriptions unless cancelled before the trial expires.

6. User Content and Data Ownership

• You retain full ownership of all content you create, enter, or upload through the App, including journal entries, reflections, session notes, and personal data ("User Content").
• By using the App, you grant Bavity LLC a limited, non-exclusive, non-transferable, revocable license to process your User Content solely for the purpose of providing and improving the App's services, including AI-powered analysis. This license terminates upon deletion of your account.
• We do not claim ownership of your User Content. We will never sell, license, or commercially exploit your User Content.
• You are solely responsible for the accuracy and legality of your User Content. You represent that you have all rights necessary to submit such content.

7. Artificial Intelligence Features

• The App utilizes third-party AI services (OpenAI) to generate session analysis, behavioral pattern recognition, recommendations, and mid-week reflection notifications.
• AI-generated outputs are provided "as is" and may contain inaccuracies, errors, or inappropriate content. You should not rely on AI outputs as professional advice of any kind.
• Bavity LLC is not responsible for the accuracy, completeness, or suitability of any AI-generated content. You use AI features at your own discretion and risk.
• Your data transmitted for AI processing is not used to train third-party AI models. See our Privacy Policy for full details on AI data processing.

8. Acceptable Use

You agree not to:

• Use the App for any unlawful, fraudulent, or malicious purpose
• Attempt to gain unauthorized access to our systems, servers, or other users' accounts
• Interfere with, disrupt, or place an unreasonable burden on the App or its infrastructure
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
• Reproduce, distribute, sublicense, or create derivative works based on the App
• Use automated systems, bots, scripts, or scrapers to access the App or extract data
• Circumvent, disable, or interfere with any security features of the App
• Use the App to store or transmit any content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

9. Intellectual Property

All rights, title, and interest in and to the App, including but not limited to its design, architecture, source code, object code, user interface, graphics, logos, trademarks, trade dress, documentation, and all other intellectual property embodied therein, are and shall remain the exclusive property of Bavity LLC. "Soul Surgery Sunday" and the Soul Surgery Sunday logo are trademarks of Bavity LLC. No license or right is granted to you by implication, estoppel, or otherwise, except for the limited right to use the App in accordance with these Terms. Any unauthorized use of our intellectual property may result in legal action.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. BAVITY LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE FOREGOING, BAVITY LLC DOES NOT WARRANT THAT: (A) THE APP WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; (B) THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS OR INFORMATION OBTAINED FROM THE APP (INCLUDING AI-GENERATED CONTENT) WILL BE ACCURATE, RELIABLE, OR COMPLETE; (D) ANY DEFECTS IN THE APP WILL BE CORRECTED; OR (E) THE APP IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

THE APP IS NOT INTENDED TO PROVIDE AND DOES NOT CONSTITUTE MEDICAL, PSYCHOLOGICAL, PSYCHIATRIC, THERAPEUTIC, OR OTHER PROFESSIONAL ADVICE, DIAGNOSIS, OR TREATMENT. ALWAYS SEEK THE ADVICE OF QUALIFIED HEALTH PROFESSIONALS WITH ANY QUESTIONS REGARDING A MEDICAL OR MENTAL HEALTH CONDITION.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BAVITY LLC, ITS OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR USE OF OR INABILITY TO USE THE APP; (B) ANY AI-GENERATED CONTENT OR ANALYSIS; (C) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; (D) STATEMENTS OR CONDUCT OF ANY THIRD PARTY; OR (E) ANY OTHER MATTER RELATING TO THE APP, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF BAVITY LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, BAVITY LLC'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU HAVE PAID TO BAVITY LLC IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) FIFTY U.S. DOLLARS ($50.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to defend, indemnify, and hold harmless Bavity LLC, its officers, directors, members, managers, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of or access to the App; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) your User Content. This indemnification obligation shall survive the termination of these Terms and your use of the App.

13. Dispute Resolution and Arbitration

• Informal Resolution: Before initiating any formal dispute resolution, you agree to first contact us at support@soulsurgerysunday.com and attempt to resolve the dispute informally for at least thirty (30) days.
• Binding Arbitration: If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. The arbitration shall be conducted by a single arbitrator. The arbitrator's decision shall be final and enforceable in any court of competent jurisdiction.
• Class Action Waiver: YOU AND BAVITY LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
• Exceptions: Either party may bring claims in small claims court if eligible. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect intellectual property rights.
• Opt-Out: You may opt out of this arbitration provision by sending written notice to support@soulsurgerysunday.com within thirty (30) days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out of the arbitration provision.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. To the extent that litigation is permitted under these Terms, you consent to the exclusive personal jurisdiction of the state and federal courts located in the State of Delaware.

15. Termination

• You may terminate your use of the App at any time by deleting your account through the Settings page and uninstalling the App.
• We may suspend or terminate your access to the App at any time, with or without cause and with or without notice, including for violation of these Terms.
• Upon termination, your right to use the App ceases immediately. Sections 6, 9, 10, 11, 12, 13, 14, and 16 through 19 shall survive termination.
• Termination of your account does not relieve you of any obligation to pay outstanding subscription fees.

16. Force Majeure

Bavity LLC shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, government actions, power failures, internet or telecommunications failures, cyberattacks, or third-party service provider outages.

17. Modifications to Terms

We reserve the right to modify, amend, or update these Terms at any time in our sole discretion. Material changes will be communicated by posting the revised Terms within the App, updating the "Last Updated" date, and, where appropriate, notifying you via email or push notification. Your continued use of the App following the posting of revised Terms constitutes your acceptance of such changes. If you do not agree to the revised Terms, you must stop using the App and delete your account.

18. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision, and all remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy and any applicable subscription terms presented at the time of purchase, constitute the entire agreement between you and Bavity LLC regarding your use of the App and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and Bavity LLC. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
